By entering the "Australia´s Got Talent / KIT KAT" competition, you are agreeing to the following terms and conditions:

1.
STANDARD TERMS
1.1
Information on how to enter forms part of the terms of entry.
2.
WHO CAN ENTER?
2.1
Subject to clause 2.2, entry is open to all residents of Australia where the Channel Seven signal is received.
2.2
Employees and their immediate families of Seven Network (Operations) Limited ("The Promoter"), Yahoo!7 Pty Limited, Nestlé Australia Ltd and their associated agencies and companies are not eligible to enter.
3.
HOW TO ENTER
3.1
The competition commences on Tuesday 13 May 2008 @ 19:31 Australian Eastern Standard Time ("AEST") and concludes on Tuesday 10 June 2008 @ 19.30 AEST ("the Competition Period") however, the eligible entry period for each week will commence and conclude on the following dates and times:

3.2
In order to enter, viewers must watch Australia´s Got Talent ("the Program") on the Seven Network during the Competition Period. Each week there will be a competition segment aired during the Program (or any replacement program broadcast in the (Australia´s Got Talent timeslot), during which viewers will be invited to submit a video of their most talented moments. Maximum file size for each submission is 2MB.
3.3
In order to enter, viewers must either;
a)
Upload their video online at www.yahoo7.com.au/talent and register their name, address, state, postcode and daytime telephone number (including STD area code) or
b)
Send an MMS from their mobile phone along with their full name and video title to 0488 980 901.
3.4
Entrants may enter as many times as they like, but each entry must be different.
3.5
The time each entry is received will in each case be the time the MMS message or online video upload is received by the m.Net Corporation Ltd database.
3.6
The entry must be:
a)
the original independent creation of the entrant; and
b)
free from any claims, including copyright or trademark claims, by other parties.
3.7
Entry details remain the property of the Promoter and Sponsor and will not be returned to the entrant. By entering the competition the winner and all finalists agree to grant the Promoter a perpetual and non-exclusive license to use their entries in all media worldwide and the winner and Finalists will not be entitled to any fee for such use.
3.8
Each MMS entry will be charged at the entrant´s standard MMS rate.
3.9
All entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
3.10
Any entry which is considered offensive, violent or discriminatory in any manner will be deemed invalid.
4.
GRAND PRIZE
4.1
There will be 4 finalists selected by a judging panel each week for 4 weeks. Each week the public will be invited to vote/rank the 4 finalists for that week. The video receiving the highest number of votes/highest rank each week will be selected as a grand finalist, (1 from each week). The judging panel will select the winner from the 4 grand finalists as the major prize winner.
4.2
The major prize package is:

Total prize value is up to $7,513 inc GST. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
4.3
In participating in the prize, the winner and their travel companions agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed and agree to grant the Promoter a perpetual and exclusive license to use such footage and photographs in all media worldwide without any fee for such use.
4.4
The prize cannot be transferred or redeemed for cash. The winner should seek independent financial advice about any tax implications that may arise from winning the prize.
4.5
The winner and their travel companions are responsible for all additional expenses including but not limited to meals (unless specified), incidentals, tips, service charges, spending money, travel insurance and all transfers other than those specified. Travel insurance is not included in the prize and will be the responsibility of the winner. Travel insurance is highly recommended.
4.6
The prize is valid for travel until 23 June 2008 to 23 June 2009, excluding December 2008 & January 2009 and must be booked at least 60 days prior to departure.
4.7
Travel arrangements to and from their nearest capital city airport do not form part of the prize and are the responsibility of the winner.
4.8
If a winner and travel companions reside within the State of the prize destination, flights and airport transfers do not form part of the prize and winner will have no claim to exchange flights or transfers for other destinations.
4.9
Flights and accommodation are subject to availability at the time of booking.
4.10
The prize is non-transferable and cannot be exchanged for other destinations. There will be no credit given if the full value of prize is not utilised.
4.11
Flights cannot be taken during peak travel periods and travel is on confirmed space but is subject to seat availability at the time of booking.
4.12
The prize winner and their travel companions must travel on the same flights together.
4.13
The winner agrees that they will not and will ensure that their companions do not sell or otherwise make available their story and/or photographs to any media or other organisation.
4.14
If the winner is under the age of 18 as at the date of the judging, the prize will be awarded to their parent or legal guardian.
4.15
Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize.
4.16

5.
JUDGING & PRIZE NOTIFICATION
5.1
The grand prize winner will be the entry judged to be the most creative and/or original from the 4 grand finalists. Judging will be completed by 10.00 AEST on Monday 23 June 2008. The competition is a game of skill and chance plays no part in determining the winner.
5.2
The grand finalists and the grand prize winner will be notified by a phone call on the day of the judging, and a letter advising the grand prize winner of their prize will also be sent via express post.
5.3
The judges decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result.
5.4
It is a condition of accepting the prize that the winner (and their travel companions) must comply with all the conditions of taking the prize and prize supplier´s requirements.
5.5
It is a condition of accepting the prize that the winner and their travel companions may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
6.
NO LIABILITY
6.1
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel, modify or suspend the competition.
6.2
Seven Network (Operations) Limited, the Sponsor and its franchisees and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3
The Promoter & its affiliates, the sponsor and its franchisees and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur by an entrant:
a)
during the judging;
b
whilst undertaking any travel won on or connected with their entry into the competition; or
c)
in taking any prize;
d)
as a consequence of late, lost or misdirected mail;
e)
due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
f)
in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion;
g)
arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant´s or any other person´s computer software related to or resulting from participation in this promotion
6.4
The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of programming, scheduling or production requirements.
6.5
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter´s legal rights to recover damages or other compensation from such an offender are reserved.
6.6
The Promoter is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.7
If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition
7.

7.2
The Sponsor is Nestlé Australia Ltd (ABN 77 000 011 316) of Building D, 1 Homebush Bay Drive, Rhodes NSW 2138 Australia.
7.3
The Promoter and its related entities ("Seven"), is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant may request access to his or her personal information by writing to Privacy Officer, c/- Legal Department, Seven Network Limited, PO Box 777, Pyrmont, NSW, 2009.
7.4
The contact details of entrants who agree to provide their contact details to the Sponsor will have their details held in accordance with the Nestlé Privacy Policy which can be accessed by visiting www.nestle.com.au or calling 1800 005 510.
