Terms and Conditions

1.1

Information on how to enter forms part of the terms of entry.

2.1

Subject to clause 2.2, entry is open to all residents of AUSTRALIA.

2.2

Employees and their immediate families of Yahoo!7 Pty Limited, Seven Network (Operations) Limited, Nestlé Australia Ltd, and their associated agencies and companies are not eligible to enter.

HOW TO ENTER

3.1

The Competition commences on Wednesday 21st May 2008 @ 09.00 AEST and concludes on Friday 20th June 2008 @ 23.59 AEST ( "the Competition Period"),

3.2

In order to vote/enter, participants must vote for their favourite Australia´s Got Talent / KIT KAT video at www.yahoo7.com.au/talent and register their name, email address, address ( including postcode), daytime telephone number (including STD area code) and comply with these Terms and Conditions.

3.3

Entrant´s in the Competition may vote/enter as many times as they like, but may not use "scripting" for multiple votes/entries (which will be deemed invalid).

3.4

Votes/Entries must be received by Friday 20th June 2008 @ 23.59 AEST.

4.

PRIZES

4.1

There will be one (1) major prize winners drawn from all voting entries received during the promotion from Wednesday 21st May 2008 @ 09:00 AEST and Friday 20th June 2008 @ 23.59 AEST. The major prize winners will each win the following prize package:

4.2

Total prize value is $7,513 inc GST. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.

4.3

In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners agree to granting the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.

4.4

Prizes cannot be transferred or redeemed for cash. Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

4.5

The winner and their travelling companions are responsible for all other expenses including but not limited to meals (unless specified), incidentals, tips, service charges, spending money, travel insurance, airport taxes, visas and all transfers other than those specified. Travel insurance is not included in the prize and will be the responsibility of the winner. Travel insurance is highly recommended.

4.6

The prize is valid for travel from 23rd June 2008 to 23rd June 2009 excluding Dec/Jan and must be booked at least 60 days prior to departure.

4.7

If the prize winner and their companion are from a regional area, travel arrangements to and from the nearest capital city airport do not form part of the prize and are the responsibility of the winner.

4.8

If a winner and companion reside within the state of the of their prize destination, flights and airport transfers do not form part of the prize and winner will have no claim to exchanged flights or transfers for other destinations.

4.9

Flights and accommodation are subject to availability at the time of booking and embargo periods.

4.10

The prize is not valid December and January and 60 days advance booking is required.

4.11

The prize is non-transferable and cannot be exchanged for other destinations. There will be no credit given if the full value of prize is not utilised.

4.12

Flights cannot be taken during peak travel periods and travel is on confirmed space but is till subject to seat availability at the time of booking.

4.13

The prize winner and their travelling companions must travel on the same flight as each other to their destination and must travel together.

4.14

The winner agree that they will not and will ensure that their companions do not sell or otherwise make available their story and/or photographs to any media or other organisation.

4.15

If the winner is under the age of 18 as at the date of the draw, the prize will be awarded to their parent or legal guardian as nominated by the winner.

4.16

Once booked, any changes made to the booking may incur a cancellation fee of amendment fee, at the cost of the winner. The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize.

HOW TO WIN

5.1

There will be one (1) major prize winner drawn from the national pool of entrants received. Each entrant who has entered the Competition by the closing time in accordance with clause 3 will be entered into the major prize draw. The major prize winner will be drawn Monday 23rd June 2008 @ 10.00 AEST. The draw will take place at m.Net Corporation Ltd., Level 2, 8 Leigh Street, Adelaide, South Australia 5000.

5.2

The winner will be contacted by phone within 2 days of the draw, and a letter advising the winner of their prize will also be express posted. The winner´s details will be published in the Public Notes section of The Australian newspaper on Monday 30th June 2008.

5.3

The Promoter´s decision is final and the Promoter will not enter into correspondence regarding the result.

5.4

It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier´s requirements.

5.5

It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

5.6

Subject to any written directions given under regulation 37 of the Lottery and Gaming Regulation 1993 (SA), an unclaimed prize draw will take place at m.Net Corporation Ltd., Level 2, 8 Leigh Street, Adelaide, South Australia 5000 Monday 20th October 2008 @ 10.00 AEST and the winner’s details will be published in the Public Notes section of The Australian newspaper on Monday 27th October 2008.

6.

NO LIABILITY

6.1

The Seven Network (Operations) Ltd & affiliates, m.Net Corporation Ltd, Nestlé Australia Ltd and their associated agencies and companies associated with this promotion, including will not be liable for any misadventure, accident, injury, loss or claim that may occur:

a)

during the draw;

b)

whilst undertaking any travel won on or connected with their entry into the draw; or

c)

in the participation in any prize;

d)

as a consequence of late, lost or misdirected mail;

e)

due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any company, staff member, journalist, other entrants or any other person;

f)

in relation to failure of an SMS entry message to be received by the Promoter on account of technical problems or traffic congestion;

g)

arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion; or

h)

arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant´s or any other person´s computer software related to or resulting from participation in this promotion

i)

in relation to failure of an online entry to be received by the Promoter on account of technical problems or traffic congestion

j)

due to circumstances outside the promoter´s reasonable control.

6.2

Subject to State Regulation, in the case of the intervention of any outside act, agent or event which prevents or significantly hinders the promoter´s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

6.3

Seven Network (Operations) Ltd & affiliates, m.Net Corporation Ltd, Nestlé Australia Ltd and their associated agencies and companies associated with this promotion assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.

6.4

Subject to State Regulation, if for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

7.2

7.3

Entry details remain the property of the promoter. m.Net Corporation Ltd on behalf of Seven Network Limited (ABN 65 052 845 262) and its related entities ("Seven"), is collecting the entrant´s personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winners). The entrant´s personal information may be disclosed to m.Net Corporation Ltd for this purpose. The entrant may request access to his or her personal information by writing to Privacy Officer, m.Net Corporation Ltd, Level 2, 8 Leigh Street, Adelaide SA 5000.
